It provides what freedoms Americans have and how they can be used. These rights are a way to show that everyone has natural rights and it is an indication of how lives can be affected socially. For example, when one goes to trial they have a right to speak their opinions and to not speak at all. The rights in general are a group of freedoms that Americans have and can use at any time. Although there may be proof prior to a trial that someone is guilty, that does not disregard the fact that they have the right to have a fair and speedy trial.
Going to trial primarily means that someone is accused or convicted for a crime. Not allowing a fair trial would indicate unnecessary punishment and even discrimination towards the defendant. The defendant should be given the appropriate respect and opportunity to convey their point of view. There are many cases where the person on trial is not given the right to a fair trial and in they end they are usually said to be guilty when they are not. Paul Robeson was an African American being accused of being part of the Communist Party. Robeson believed in a few communist ideas however, he never acted upon them. During the trial, Robeson used his fifth amendment rights but Mr.Arens, who is part of the opposing party, continued to try to get Robeson guilty by getting him to say that he is part of the Communist Party. As a U.S citizen, Robeson had every right to plead to the fifth amendment yet the court was not accepting his statement. This went against the right to have a fair and speedy trial because Robeson’s statements were not being accepted and he was forced to answer differently. In the end of the trial, Mr.Arens was called out for his discriminatory actions against Robeson and the unfairness he faced at trial.
In many trials there is usually evidence against the defendant but that does not mean that the right to have a fair trial should be ignored. The defendant should be allowed to prove their stance and be given the appropriate treatment on trial. Having the right to a fair and speedy trial allows those on trial to prove their point and to argue the evidence at hand. In some cases the evidence may be interpreted wrong and if the person on trial is not given the opportunity to provide an explanation then it would not be fair. Paul Robeson was one of many Americans who were not given a fair trial and many spent years in jail for invalid reasons. No matter how much evidence there is on a person they deserve to be respected during trial and be given a fair chance throughout.
