Tom Robinson: An Innocent Man On Trial

If your significant other was accused and charged with a crime they did not commit that costed them their life, would you want to receive compensation? As you watch your them being put on trial, convicted, and being charged over something they were not guilty of. As you struggle to keep a roof over your family’s head and food on the table. As you watch your whole life slip away right in front of you, just because your significant other was charged with a crime they did not commit. Would you want compensation?

What is defamination? Defamination is a false unprivileged statement of facts that is harmful to someone’s reputation. To prove defamination, the plaintiff must show four things; a false statement purporting to be fact, publication or communication of that statement to a third person, fault amounting to at least negligence, and damages, or some harm caused to the person or entity who is the subject of the statement. Did defamination of Mrs. Robinson occur at the hands of Bob Ewell? Bob Ewell blames Mrs. Robinson for what suposidally happened to his daughter, so when he sees her places he is very disrespectful towards her. This most likely causes a harmful impact of Mrs. Robinsons reputation because everyone thinks her husbamd is a rapist.

What is mental anguish? Mental anguish is suffering that may include distress, anxiety, fright, greif, or depression. How would you prove mental anquish? There must be evidence of nature, severity or duration of plaintiffs anquish substantially disrupting the injured party’s daily routine, or such a high degree of mental pain that is much stronger than anger, embarrassment, anxiety, or worry. Mr. Ewell caused Mrs. Robinson mental anquish becuiase when he sees her in public he harrasses her. From the book the first time she tried to use the public road he “chucked at her.”

What is my position in this situation? I think Tom Robinson was wrongfully accused of a crime he did not commit and it eventually costed him his life. I believe Mrs. Robinson should receive a 2,000 dollar compensation due to her husbands death. Mrs. Robinson is grieving in ways nobody could understand because her husband was wrongfully accused of a rape that he is innocent of. Nobody should have to go through that trauma, and have to worry about their children’s well-being. 

To sum up everything that has been stated, Tom Robinson was innocent. He should not of been killed, or even convicted of this crime. I think Mr. Ewell and his daughter should be held accountable for their actions because their false accusation costed a man his life. Mr. Ewell also caused a lot of mental anguish in Mrs. Robinson because he husband was killed and is dealing with alot of pain and grief.
